UNISON wins unfair dismissal case in Shetland
UNISON has won compensation for a member unfairly dismissed
from Shetland Amenity Trust.
UNISON member and project officer Michael Mann was sacked
last summer after taking time off work to attend a course
to treat an alcohol problem. In March an employment tribunal
heard that the sacking occurred shortly after he had made
a complete recovery and only weeks before he would have been
ready to return to work, and despite the presentation of a
doctor's certificate confirming this.
Among thew criticisms levelled at the Trust by the tribunal
was that it decided to dismiss Mr Mann at a hearing at which
was not able to be present
Expressing his satisfaction with the tribunal's decision
Mr Mann said, "It is my wish that this ruling from the tribunal
panel can bring some closure on what has been an extremely
difficult eight months for myself and my family.
"My position at the amenity trust was one that I enjoyed
immensely and had hoped to return to when I returned from
my period of illness. "I would like to publicly express my
gratitude to UNISON and my legal representatives for their
resolute support throughout this case.
"Thanks also to all the friends and members of the public
who have expressed a voice.
UNISON Branch Secretary Tracey Leith said, "If an employer
has no procedures or policies to deal with the likes of ill-health
than unfairness will creep in but the union is always there
to protect members."
